Terms of service

These terms apply to schools and users of LuchamSkonga, a service of Lucham Digital Agency Limited ("we"). By registering a school or using LuchamSkonga you agree to them.

1. Accounts

• A school's registration is reviewed before the school account is created. We may decline a registration.
• The school is responsible for who it gives access to, for the roles it assigns and for keeping user details up to date.
• Users must keep their passwords private and tell their school administrator if they suspect misuse.

2. Subscriptions and billing

• Packages are based on the number of students. Prices are shown in Tanzanian shillings; the price on the invoice applies.
• A plan starts or renews when payment is confirmed. We send reminders before a subscription ends.
• After the end date there is a grace period with full access. If the subscription is still not renewed, the account becomes read-only until payment is received. Data is not deleted because a subscription ends.
• A school may not enrol more students or staff accounts than its package allows; it can move to a larger package at any time.
• The LuchamSkonga subscription paid by the school is separate from school fees paid by parents to the school.

3. School fees and online payments

When a school collects fees online, payments are processed by Pesapal under the school's merchant account and Pesapal's own terms. The school is responsible for its fee amounts, refunds and receipts to parents. A payment is credited in LuchamSkonga only after it is confirmed with the payment provider.

4. Acceptable use

• Use LuchamSkonga only for the school's legitimate purposes and in line with the law.
• Send SMS and notifications only to people who have agreed to receive them, and never include passwords or unnecessary sensitive student information.
• Do not try to access another school's data, test the system's security without our written permission, or disrupt the service.

5. Data

The school owns the records it enters. We process them as described in our privacy policy. The school is responsible for having a lawful basis to record students', parents' and staff's information.

6. Availability and changes

We work to keep LuchamSkonga available and secure but cannot guarantee uninterrupted service. We may improve or change features; we will give notice of material changes that affect schools.

7. Liability

To the extent permitted by law, our liability for any claim relating to the service is limited to the subscription fees the school paid in the twelve months before the claim.

8. Ending the service

A school may stop using LuchamSkonga at any time. We may suspend an account that breaches these terms. On request, we will help a departing school export its records.

9. Law

These terms are governed by the laws of the United Republic of Tanzania.
